2. These terms
These terms apply to all orders placed through our website. Please read them before ordering. By placing an order you agree to be bound by them.
Our Privacy Policy, Refund Policy and Shipping Policy also form part of these terms.
These terms are written in English and the contract between us will be concluded in English.
3. Placing an order
Our website is an invitation to buy, not an offer. When you place an order you are making an offer to purchase.
We will send you an email acknowledging your order. This is not acceptance. A contract is formed only when we send you a separate email confirming that your order has been accepted.
We may decline an order for any reason, including where the product is unavailable, where there has been a pricing or description error, or where we are unable to deliver to your address. If we decline your order we will tell you and refund any payment in full.
You must be at least 18 years old to place an order.
4. Price and payment
The price of the goods is the price shown on the website at the time you place your order. Prices include delivery to mainland UK addresses unless stated otherwise. Some remote areas may be subject to an additional charge, which we will confirm with you before accepting your order.
Payment is taken at the time you place your order. If your order is not accepted, we will refund you in full.
We take reasonable care to ensure prices are correct. If we discover an error in the price of goods you have ordered, we will contact you to ask whether you wish to proceed at the correct price or cancel. If we cannot reach you, we will treat the order as cancelled and refund you in full.
5. Delivery
Delivery arrangements, timescales and access requirements are set out in our Shipping Policy, which forms part of these terms.
Goods remain our responsibility until they are delivered to the address you have given us. They become your responsibility from that point.
6. Your right to cancel
You have a legal right to cancel your order within 14 days of delivery, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Full details of how to cancel, return costs, and the condition goods must be in, are set out in our Refund Policy.
7. Your legal rights if something is wrong
We are under a legal duty to supply goods that are as described, of satisfactory quality and fit for purpose.
Nothing in these terms affects your legal rights under the Consumer Rights Act 2015. If goods are faulty, not as described, or not fit for purpose, you may be entitled to a repair, a replacement, a price reduction or a refund depending on the circumstances.
For detailed information about your rights, visit the Citizens Advice website at citizensadvice.org.uk or call 0808 223 1133.
8. Manufacturer's warranty
Our saunas carry a 5-year structural warranty covering the timber and joinery, provided by the manufacturer and running from the date of delivery.
This warranty is in addition to, and does not affect, your legal rights under the Consumer Rights Act 2015.
The warranty is subject to conditions, including a requirement that exterior timber supplied untreated is treated with a suitable wood preservative as soon as assembly is complete, and maintained thereafter. Full details are set out in our Warranty Policy.
If you need to make a warranty claim, contact us at hello@northcabin.co.uk. We will handle the claim and liaise with our manufacturing partner on your behalf.
9. Product information
We take care to describe our products accurately. Images, 3D renders and diagrams are illustrative. Timber is a natural material and colour, grain and finish will vary between individual products and from how they appear on your screen.
Dimensions, specifications and capacities are provided by our manufacturing partner and are given in good faith. Where a stated capacity refers to the number of people, this is a guide based on internal area and bench layout, not a safety limit.
We may change or discontinue products at any time.
10. Assembly and site preparation
Our saunas are supplied as flat-pack kits for self-assembly. You are responsible for:
- preparing a firm, level base suitable for the product before delivery
- checking all components against the parts list before beginning assembly
- assembling the product in accordance with the supplied instructions
- arranging any electrical work, which must be carried out by a qualified electrician in accordance with current UK wiring regulations
- obtaining any planning permission or building control approval that may be required
We are not responsible for any loss or damage arising from inadequate base preparation, assembly not carried out in accordance with the instructions, or electrical work not carried out by a qualified person.
11. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights in relation to the goods.
We are not liable for business losses. We supply goods for domestic and private use. If you use the goods for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
12. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, including extreme weather, industrial action, supply chain failure, or transport disruption. If such an event occurs we will contact you as soon as possible and, where the delay is substantial, you may cancel your order and receive a full refund.
13. Our website
The content of our website, including text, images, logos and design, is owned by or licensed to us and is protected by copyright and trade mark law. You may view and print pages for your own personal use, but may not reproduce or use our content commercially without our written permission.
You agree not to use our website unlawfully, to introduce malicious code, or to attempt to gain unauthorised access to it.
14. Your personal information
We handle your personal information in accordance with our Privacy Policy.
15. Complaints
If you are unhappy with our products or service, please contact us at hello@northcabin.co.uk. We aim to acknowledge complaints within two working days and resolve them as quickly as possible.
16. Governing law
These terms are governed by the law of England and Wales, and any dispute may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you live.
17. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are those published on our website at the time you placed it.
18. General
If any part of these terms is found to be unlawful or unenforceable, the remaining terms continue to apply.
If we do not insist that you perform an obligation under these terms, or delay in enforcing our rights, that does not mean we have waived those rights.
We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens and will ensure the transfer does not affect your rights.
